Accuracy of Content
We have taken every care in the preparation of the content of this website, to ensure that prices quoted are correct at time of publishing and all products have been fairly described including, without limitation, terms and conditions concerning guarantees. For these reasons, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised. All prices are displayed exclusive of VAT.
All dimensions quoted are approximate only. To the extent permitted by applicable law, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the content on this website. We shall not be liable for any loss or damage which may arise from the use of any of the information contained on this website. We cannot confirm the final price of goods until your order is accepted in accordance with our Contract.
The Contract
When confirmation of an order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we have received your payment and we send you an invoice.
The completion of the contract between you and us will take place on despatch of the goods ordered to you unless we have notified you that we are unable to accept your order, or you decide to cancel it by contacting our customer service team on 01439 770234 any time between 8.30am and 4.30pm, Monday to Friday except Bank Holidays.
The principal reasons that would lead to non-acceptance of an order will include: the goods you ordered are unavailable from stock; authorisation for your payment was declined or a pricing or description error of the goods through our mistake.
Making a Purchase
To purchase from us you must be resident in the United Kingdom mainland. We cannot ship to locations outside of the United Kingdom mainland.
Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on ‘Checkout’ and you will be asked for a few details that we need to be able to complete the order.
All prices are in British Pounds and exclude delivery and VAT unless stated. VAT is charged at 20%. Payment in full for the goods ordered will be made at the time of the order. We are not obliged to supply the goods to you until we have accepted your order and received payment in full.
We accept payments through paypal or direct bank transfer.
For all non standard orders, the customer shall provide accurate dimensions and a description of the area for which the products are being made. We shall not be responsible for any mistakes that the customer makes in providing the measurements.
By placing an order you are agreeing to buy the goods and allowing us to use your personal details to supply the goods to you (including passing your details on to subcontractors and couriers where necessary).
The site and the goods sold through it are subject to change without notice and we reserve the right to improve, alter or modify designs without prior notification. We will inform you of any changes to the advertised goods prior to dispatch of such goods. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
Credit Card Security
We do not store any credit card information.
Delivery
We will advise you of availability of goods at the time of ordering. Any specified period for delivery shall be deemed to commence once all details of the order and payment have been finalised. All delivery dates are subject to change. Before your goods are shipped we will contact you by email or phone to confirm our target delivery date.
Cancellation and Refunds
Under the Consumer Contracts Regulations 2013 law you have the legal right to cancel your order from the moment it is placed until 14 days from the day you received it on all our standard products, with the exception of any non-standard goods made to the customer’s specification.
If you are unhappy with your goods you must inform us in writing (including fax or e-mail) within 14 days of receiving the goods or telephone us on 01439 770234. In order to receive a refund the goods must be returned unused, undamaged and, if possible, in their original packaging; together with your receipt. Returned items must be returned “as new” and in a resaleable condition. All goods should be returned to us at Duncombe Sawmill Ltd., Sawmill Lane, Helmsley, York YO62 5DQ.
We will refund the price of the item to you or exchange the goods if they were delivered to you in error or in a damaged or faulty condition once it is received by us.
If we find that the product returned to us in damaged condition and unsuitable for resale, we reserve the right to refuse a refund on the item.
Carriage costs will only be refunded if the item is incorrect, faulty or if it differs in any way from the advertised goods. Returned parcels remain the responsibility of the customer until they are received by us. If you would like to arrange for us to collect the returned item, return carriage costs will be deducted from any refund due.
We are unable to accept cancellation of an order for any non standard products that are made to the customer’s specification. Our 14 day money back guarantee will not apply to these items either unless they are found to be damaged or faulty on delivery to you.
Your rights to return goods are protected under the EU Distance Selling Directive which can be found at http://www.hmso.gov.uk/si/si2000/20002334.htm
We guarantee all our materials for a period of 1 year. In the case of damaged or defective goods, our guarantee covers the costs of replacing the defective product; however it does not cover consequential expenses incurred as a result of replacing the product, such as fitting and finishing costs. We will not accept any liability for any damage caused by incorrect assembly of fittings, incorrect hanging or incorrect or lack of treatment to timber. We cannot accept any responsibility for small defects in timber which occur after the products have left the workshop due to the natural movement of timber. For gates we are unable to give a warranty against splitting, shrinkage, or warping which are caused by natural reactions. We will not reimburse the cost of repairs to gates without prior consent; such repairs would invalidate the guarantee. The company guarantee will not cover twisting of gates where automation is fitted.

Duncombe Sawmill Limited does not disclose buyers’ information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.
We will take all reasonable care within our control to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if an unauthorised third party accesses any data you provide when ordering from our website.
It is your responsibility to protect your password and account details from misuse. We shall not be liable for any loss or damage which may arise as a result of your failure to protect your password or account details.
Cookies are used on this shopping site to keep track of the contents of your shopping cart, to store delivery addresses if the address book is used and to store your details if you select to sign in. Nothing in these Terms & Conditions shall exclude our liability for death or personal injury due to our negligence or for fraudulent misrepresentation.
We will not be liable, in any way for losses or damages arising from the use of this website or from the misuse of goods purchased from this website.
If any part of these Terms & Conditions is deemed to be unlawful, void or for any reason unenforceable, then that provision or part of a provision, as applicable, will be able to be removed from these Terms & Conditions without affecting the validity and enforceability of any of the remaining provisions of these Terms & Conditions.
No waiver by us of any term or provision should be considered as a waiver of any other term or provision within these Terms & Conditions.

Your Statutory Rights are not affected by these terms and conditions. Nothing in this Clause shall limit or exclude our liability to you in respect of any fraudulent or negligent misrepresentation whether or not these have become incorporated in these Terms & Conditions.
Law
These Terms & Conditions shall be governed by the laws of England & Wales.
